Judge blocks California's low-carbon fuel rules

A federal judge on Thursday temporarily halted California's ability to enforce rules to reduce the carbon footprint of transportation fuels, effectively taking the regulatory teeth out of the state's year-old program.

U.S. District Judge Lawrence O'Neill issued a preliminary injunction that ruled the California Air Resources Board's low-carbon fuel regulations violated the U.S. Constitution's commerce clause by discriminating against crude oil and biofuels producers located outside California.

The regulations require producers, refiners and importers of gasoline and diesel to reduce the carbon footprint of their fuel by 10% over the next decade, as part of California's landmark global-warming law aimed at reducing greenhouse gas emissions to 1990 levels by 2020.

The regulation calculates the life cycle of fuels from their extraction ? or cultivation, in the case of biofuels such as corn-based ethanol ? to their combustion. For example, the state considers how corn is grown, harvested and converted to ethanol intended for California gas tanks, a life-cycle evaluation called "seeds to wheels."

Industry groups applauded the decision and said the program would have resulted in higher fuel costs for California consumers.

In a joint statement, Bob Dineen, president of the Renewable Fuels Assn., and Tom Buis, chief executive of Growth Energy, which were plaintiffs in the case, said, "With this ruling, it is our hope that the California regulators will come back to the table to work on a thoughtful, fair, and ultimately achievable strategy for improving our environment by incentivizing the growth and evolution of American renewable fuels."

The judge's ruling did not invalidate the air board's low-carbon fuel program or its reporting requirements. But the injunction does remove the state's ability to punish fuel wholesalers and refineries that sell gasoline or biofuels whose carbon footprint exceeds state guidelines.

In the first year of the program, wholesalers were to reduce the carbon footprint of their products 0.25% .

Air board spokesman Stanley Young defended the program as "an evenhanded standard that encourages the use of cleaner low carbon fuels," adding that "it does not discriminate against any fuels on the basis of geography."

Young said the agency will go back to O'Neill's court next week seeking clarification of the ruling and will appeal to the U.S. 9th Circuit Court of Appeals.

Oil refiners and corn-ethanol producers filed suit last year, alleging that the mandate was unfairly punitive to out-of-state fuel suppliers.

As described in The Supreme Court Won't Strike Health Reform - Part I, the forecast for the entire Affordable Care Act, or "Obamacare," is partly sunny. Here in Part II is the forecast for the Act's Medicaid expansion and an analysis of whether the individual mandate's penalty is a tax. If it is, then under the Anti-Injunction Act, the Supreme Court cannot review the constitutionality of the mandate at all right now. But again, the prediction is that lightning is not likely to strike down health reform.

The Medicaid Expansion: Why It Will Survive & the Potential for New Federalism Winds

Fair weather is expected for health reform's Medicaid expansion. But, the legal relationship between the state and federal governments -- what scholars dub "federalism" -- may need to be closely watched as the Supreme Court considers the expansion. New federalism winds appear likely to blow.

First, what exactly is Medicaid? Medicaid is the country's medical "welfare" for eligible low-income persons. It grew out of social movements that provided assistance to some, but not all the poor, primarily those believed to be "deserving." Typically, those eligible for Medicaid include low-income children, pregnant women, the elderly, blind or disabled persons, and those in need of nursing home care. The 2010 health reform act expands Medicaid eligibility to anyone below the age of 65 with income less than 133% of the federal poverty line.

Medicaid differs from Medicare, which is a fee-based medical insurance program for the elderly run wholly by the federal government. Medicaid is state-run but funded with both state and federal dollars. Federal Medicaid funding is substantial -- between 50% and 83%, depending on varying factors in each state -- plus, federal funds cover about half of the states' administrative costs.

Medicaid epitomizes congressional spending for what the Constitution calls our "General Welfare," and exemplifies "cooperative federalism" between the state and federal governments. The federal purse provides an incentive for states to agree to provide medical assistance to their poor, but when they accept federal dollars, they must comply with federal Medicaid requirements.

After Obamacare, 26 states are claiming before the Supreme Court that they do not agree with the expansion of Medicaid. They attack these reforms as "unaffordable," since they must administer Medicaid and share in some of its costs.

The states claim that they're incapable of quitting Medicaid because they've become so dependent on its substantial federal funding, and that if they refused federal dollars, they could not possibly absorb the entire cost of their poor's medical needs. They attack this dilemma -- the unaffordability of Medicaid's expansion, yet their incapability of quitting Medicaid -- as unconstitutional "coercion."

Their attack could spur the Supreme Court to specify new federalism constraints on Congress' spending power.

In 1987's South Dakota v. Dole and 1992's New York v. US, the Court restricted Congress' use of the spending power by forbidding the national government from compelling or "coercing" the states. The Court never explained where this restriction came from, and failed to explicitly attach it to the 10th Amendment, which reserves powers not delegated to the federal government "to the states...or to the people."

However, in more recent cases (2006's Arlington Central Sch. Dist. Bd. of Ed. v. Murphy, 2010's US v. Comstock, and 2011's Bond v. US), several Justices have written further on the 10th Amendment and its limitations, and dropped clues that the "coercion" restriction may actually stem from that amendment.

The Court may use the Medicaid expansion as an opportunity to announce a new doctrine of federalism that explicitly roots the coercion limitation in the 10th Amendment, and spell out a new inter-relationship between the state and federal governments. This could impact a number of federal programs that depend on the provision of federal funds to the states, and could become a major doctrinal shift in favor of the states.

Even so, the Court is not predicted to topple the expansion as "coercive," and here's why: Congress increased federal funding to cover the total cost of Medicaid's expansion until 2016, then gradually tapering to cover 90% of its costs by 2020 and beyond, to ease the expansion's fiscal impact on states. And, Congress is giving states ample time to adapt to the change -- until 2014.

In light of these mitigating actions, the "coercion" argument loses its force. Indeed, a number of other states have disagreed with the 26 challengers, embracing the reform act's expansion of Medicaid precisely because they appreciate the additional federal funding.

Given that no court has found "coercion" to date, the headwinds of judicial restraint will likely deter the Court from announcing a brand new federalism doctrine and using it to strike health reform's Medicaid expansion. Worth watching, however, will be how blustery any new constraining winds on the spending power gust for federalism in the future.

The Anti-Injunction Act (AIA): Strange Bedfellows on Whether the Mandate's Penalty is a "Tax"

One key thing to remember is that the Anti-Injunction Act (AIA) could block all legal attacks on the individual mandate. Two judges of the Fourth Circuit Court of Appeals and one judge of the D.C. Circuit concluded that all challenges to the mandate must be dismissed due to the AIA. In their view, the monetary penalty for failing to comply with the mandate equates to a tax, and if they're right, the AIA will knock the wind out of all the attacking storms.

First, what does the AIA do? The AIA is a Reconstruction-era statute that bars any lawsuit challenging "taxes" or monetary penalties legally equivalent to taxes.

The AIA is jurisdictional, which means it concerns whether the Supreme Court even has the power to review the constitutionality of the individual mandate. The Court must decide the AIA issue before anything else, because if it applies, the Court has no authority to strike or uphold the mandate.

Why does the AIA matter? Supporters of Obamacare often justify the constitutionality of the individual mandate based on Congress' nearly unquestioned power to tax. Yet ironically, the Obama Administration cannot argue the penalty is a tax supported by the taxing power. To do so runs smack into the AIA bar.

In a perfect demonstration of "strange bedfellows," both Obama's Justice Department and the challengers to the mandate have joined forces before the Supreme Court to argue that the AIA does not apply. Because they've aligned, the Court has appointed veteran legal counsel to argue the opposing view that the AIA does apply.

If the Court holds that the penalty equates to a tax, no legal challenge can be heard until after someone pays the penalty in 2015. Rather than wait until then, both the Administration and health reform's challengers seek a ruling now on whether the mandate is constitutional under Congress' "commerce" and "necessary and proper" powers, as discussed in Part I. But, by seeking a ruling in 2012, the Administration forgoes another constitutional support for the mandate's penalty -- Congress' taxing power.

So, is the penalty a "tax" that bars review? The health reform act charges the IRS with "assessing and collecting" the mandate's penalty. Arguably:

  • The penalty is not a tax because Congress did not arm the IRS with every available tax enforcement tool to collect it. (The IRS' primary enforcement of the penalty will be withholding from individual tax refunds.)
  • The penalty is a tax because the statute's text plainly refers to it as being "assessed and collected" by the IRS, like any other tax penalty.


Which argument will win is difficult to predict, but the Court's nine Justices have repeatedly expressed a penchant for strict reading of simple statutory text.

The Court has also interpreted the AIA very broadly, holding in three cases, Bob Jones Univ. v. Simon, Alexander v. Americans United, and U.S. v. American Friends Serv. Committee, that the AIA bars suits related in any way to a tax-related matter until payment of the tax is made.

For this reason, both sides had better brace themselves: the AIA could very well become a formidable barrier to a constitutional review of the mandate at all (or at least until 2015).

And, if the AIA does bar review, health care reform will proceed on schedule toward full implementation by 2015. If the mandate is challenged again then, its attackers could find it much harder to dislodge. According to some, a bar to Supreme Court review in 2012 might be a "good solution" in a politically charged election year. Overall, therefore, Obamacare appears to be facing fair skies, despite a few clouds in the distance.

JACKSONVILLE, Fla. (AP) ? Jacksonville Jaguars running back Maurice Jones-Drew wonders how much of the NFL's efforts to prevent or properly treat concussions have to do with lawsuits brought by former players against the league and its teams.

The NFL's leading rusher spoke out about the issue again Wednesday, nearly a week after telling The Associated Press he would hide a possible head injury so he could stay in a game.

"I've had concussions before, and it wasn't this big deal about concussions," Jones-Drew said. "The only reason they're making a big deal about concussions right now is because the league is getting sued over it. Before this, you never heard about it. A couple of years ago, you didn't hear anything about it."

After NFL Commissioner Roger Goodell was grilled about his sport's concussion policies at a congressional hearing in October 2009, the league made several significant changes. Those moves have continued, including this month's addition of certified athletic trainers sitting in booths during games to keep an eye out for possible head injuries and alert teams' medical staffs.

Starting this summer, at least eight lawsuits have been filed against the NFL by dozens of retired players who say they have medical problems related to brain injuries from their time in professional football. The NFL's stance, in part, is that players knew there were risks of injury, and there was no misconduct or liability on the league's part.

Jones-Drew called the possibility of serious injury in football an "occupational hazard."

He was one of 44 players the AP interviewed recently about concussions. Slightly more than half ? 23 ? said they would try to hide a concussion and stay in a game rather than pull themselves out.

Players generally indicated they are more aware now of the possible long-term effects of jarring hits to the helmet. Five said that while they would have tried to conceal a concussion during a game in 2009, now they would seek help.

Players also said they should be better protected from their own instincts: More than two-thirds of the group the AP talked to would like to have independent neurologists on sidelines during games.

"You know playing football you're going to get hurt, right?" Jones-Drew said Wednesday. "In the back of your mind, you've got to know that the worst that can happen is you can break your neck and be paralyzed for the rest of your life, right? You have to go into every game knowing that could be what happens. Any given play that could happen to you, right? So there it is. When you sign these deals, you know in the back of your mind, that's what can happen.

"Now basketball, on the other hand, it's a different sport. Race car driving, you know that when you get in that car, there can be an opportunity for that thing to flip over and catch on fire. You see what I'm saying? It's an occupational hazard, simple as that, and you have to be willing to accept it, and I am."

Jones-Drew reiterated that he takes the risk because of his family and said he strongly believes NFL teams would be hesitant to sign players with a history of concussions. So he would hide a concussion to stay in a game, even if it meant increased potential for long-term health issues.

''I would do anything for my kids," he said. "If they're happy, I'm happy. I think they would appreciate it. As long as my kids' kids would be happy with what I did, that's what this life is about: sacrifice. It's not about you anymore, you know?"

China's factories falter, pro-growth policies eyed (Reuters)

BEIJING (Reuters) ? China's factory activity shrank again December as demand at home and abroad slackened, a purchasing managers' survey showed on Friday, reinforcing the case for pro-growth policies to underpin the world's second-largest economy.

The People's Bank of China is widely expected to lower its requirement for the amount of cash banks must hold as reserves to let lenders inject more credit into the economy to fight headwinds from Europe's debt crisis and sluggish U.S. demand.

The HSBC Purchasing Manager's Index, designed to preview the state of Chinese industry before official output data are published, inched up to 48.7 in December from a 32-month low of 47.7 in November, but fell short of the flash reading of 49.

The HSBC PMI has been mostly under 50, which demarcates expansion from contraction, since July.

"While the pace of slowdown is stabilizing somewhat, weakening external demand is starting to bite," said Qu Hongbin, China economist at HSBC.

"This, plus ongoing property market corrections, adds to calls for more aggressive action on fiscal and monetary fronts to stabilize growth and jobs, especially with prices easing rapidly."

He said China would avoid a hard economic landing so long as policy easing measures filtered through in coming months.

HSBC believes a PMI reading of as low as 48 in China still points to annual growth of 12-13 percent in industrial output.

China's once turbo-charged economy is on track to slow for a fourth successive quarter, easing further from the first quarter's 9.7 percent annual growth rate with economists expecting the final three months of the year to have slipped below 9 percent.

The official PMI, due to be published on Sunday, is expected to paint a similar picture, suggesting the world's second-largest economy is finishing 2011 on a weak note, in tandem with the global economic outlook.

Both the official and HSBC PMIs are stuck near their weakest levels since early 2009, when China took a blow from the global financial crisis.

Economists polled by Reuters earlier this month forecast the PBOC will deliver 200 bps of required reserve ratio (RRR) cuts by the end of 2012 but refrain from an outright cut in interest rates unless quarterly GDP growth dips below 8 percent.

Economists typically view growth of 7 to 8 percent as the bare minimum needed to generate enough jobs to help China absorb the urban influx of rural migrants and maintain social harmony.

"I think the government will ratchet up pro-growth policies if (quarterly) growth falls below 8 percent, otherwise the economy could face big risks," said Guotai Junan Securities economist Wang Hu in Shanghai.

"Another RRR cut could happen any time."

ROOM FOR RRR CUTS

China's central bank cut reserve requirements for commercial lenders late in November for the first time in three years.

The RRR remains at 21 percent for big banks, giving the central bank plenty of room to cut and free up funds that could be used for lending.

Persistent capital outflows from China are putting more pressure on the central bank to release cash to keep credit conditions supportive for growth.

Underlying indexes of the HSBC PMI showed softening demand at home and abroad, which helped cool inflation -- a boon for Chinese policymakers, according to the data collated by UK-based information firm, Markit.

The sub-index for overall new orders edged up to 46.9 in December from November's 45, but still signaled falling demand. New export orders shrank in a reflection of listless demand from the United States and Europe -- China's top overseas markets.

Average input costs faced by manufacturers continued to moderate as raw material prices slipped, the HSBC survey showed.

Inflation appears to be cooling, having fallen from a three-year high of 6.5 percent in July to 4.2 percent in November, creating additional room for policy easing to support growth.

HSBC's Qu expects the government to move on the fiscal front to boost job creation, cutting taxes for exporters -- a sector employing more than 30 million workers -- while increasing spending on public housing and other projects.

"On top of monetary easing, mainly in the form of further reserve ratio cuts, we have long argued that fiscal policy can and should play a more important role in stabilize growth and jobs," Qu said.

Japan says it, India close to deciding dollar swap pact

Japan and India are in the final stages of deciding on a dollar swap agreement and expect to reach agreement during Japanese Prime Minister Yoshihiko Noda's visit to India this week, Japan's finance minister said on Tuesday.

An earlier $3 billion arrangement came into force in 2008 but expired in June. The Nikkei business newspaper reported on Sunday that the new one would be set at $10 billion.

Further financial cooperation as well as Japanese support for infrastructure in India will be a key focus at talks between the leaders of the two countries, Finance Minister Jun Azumi told a news conference.

Azumi also said he expects Japan's exports will pick up early next year if the European economy stabilizes and currency levels reflect Japan's economic fundamentals.

Christmas Day Blast: Knocks For President Jonathan Over His Insensitive Comment

May we use this medium to apologize to our numerous readers that sent us links and update about the senseless bomb blast that ravaged Nigeria on Christmas day. We are so saddened about the occurrence, and we chose to not spoil your day with the bad news.

Ten hours after the unfortunate incident, Nigeria?s president Goodluck Jonathan summoned the courage to speak about the situation and here is what he has to say:

?The issue of bombing is one of the burdens we must live with until it fizzles out.? (So it has to fizzle out and not tackled?)

Many prominent Nigerians have condemned the incident and here is one that really touched us the most:

Dear Mr. President,

We should say Merry Christmas but we are not your government, we are not in the business of deception. After almost ten hours of gathering your thoughts to speak on the bomb blasts that rocked the nation yesterday, you still fell short of your own very low standards.

What did you intend to say when you said Bomb Blasts are a burden we must live with? Why do you bother to budget over a trillion for security if we must live with the burden of insecurity? How come you are still a president? We do not blame you, we blame our older ones who were stupid enough to think that where you come from and your religion was all you needed to be a competent president.

They are crying now. We all cried yesterday on the darkest Christmas day of our short lives.

While we cried and left Christmas postponed for another year, we watched as you danced your life away like there was no tomorrow. Is it true that all you care about is the fact that you are the president so whatever can happen should happen. Last night we prayed for you. We prayed that the white men should be able to make common sense so that we can budget for it and then you will have it in abundance. As it is, it is obvious sir that you are grossly lacking in common sense.

If you weren?t, you would never come out to tell a mourning nation that it should get ready to live with the burden of destruction and insecurity. That was utterly insensitive and even the dumbest of our mates, fellow Nigerian children would never descend that low to an unprecedented level of cluelessness.

We understand this is not a sane country, if this was a sane country, your ilk will not be in a job. Your security chiefs, yourself and your cabinet would have been throwing resignation letters left right and centre. But then, here is a place where people are satisfied with just being in positions that they are clueless about what to do in such positions does not matter.

Mr. President, Boko Haram defeated you in 2011. What plans are you making for 2012? Do you realise they have since improved while your security tactics remain stop and search? Do you realise they are far more coordinated than ever before? Have you thought of engaging more intelligence in curbing this menace instead of just mere brute? Yes, you have issues with concentrating for long, why not budget for a concentrator? That way you are conditioned to at least focus on being the president of Nigeria instead of our national chief chef? You are wondering where that came from? It came from cassava bread sir. You chose the menu for 2012 but we hope you realise that Boko Haram certainly has a menu.

Please Mr. President, they will look to attack again in the New Year, do what you have never done before, get your security chiefs to prevent that by all means. Contrary to your assertion, we are not prepared to live with the burden of bomb blasts. Get yourself to work and stop excusing your inability to deal with Boko Haram on the premise that they are a necessity. What is that? If you cannot lead and be a president, help yourself and resign. Please take your vice-president along. You are a twin set of incompetence.

This letter has been written with kind words, not because we are in the mood to be nice to you but because we are children and respect is a value we want to live with but our lack of it sometimes is a burden you must live with as long as you force us to live with your Boko Haram burden.

We wrote you a letter on subsidy yesterday but we figured it would be better to send this before you get our other letter. As long as your cluelessness reigns supreme in this country, we will always remind you of our angst and stake in this nation. It is not by force to live in Aso Rock. So if you must, do the right things, say the right things and learn to get the basic things right.

The Bomb Blasts darkened our Christmas but your response dampened our mood even further. This is not the way to lead a people. If you need help, we will nominate one of us to offer you words of wisdom for free. As it is, you look overwhelmed by the mere job of providing security for Nigeria let alone the other duties you swore to carry out for Nigeria.

Action point: Sack yourself sir, and take Arc. Namadi Sambo along. It is a good place to start.

We are sure this letter is not written by children, but whosoever wrote it conveys the mind of many hurting Nigerians home and abroad.

7 people shot dead in Texas home, motive unclear

GRAPEVINE, Texas (AP) ? Investigators believe that seven people who were found dead Christmas Day were cleaning up holiday wrapping paper when they were shot inside a suburban Fort Worth apartment, but a motive remains unclear.

All of the victims appeared to be related, and Grapevine police said they believe the shooter was among the dead. Investigators were meticulously searching the apartment, along with three vehicles parked outside, and didn't expect to finish until dawn on Monday.

"It appears they had just celebrated Christmas. They had opened their gifts," Grapevine Police Sgt. Robert Eberling said, adding that the apartment was decorated for the holiday, including a tree.

The four women and three men, aged 18 to 60, were found dead in an adjoining kitchen and living room area when police arrived midday Sunday, shortly after receiving a 911 call in which no one was on the other line, Eberling said. Two handguns were found near the bodies, he said.

None of the victims has been identified, but Eberling said it appears they all died of gunshot wounds. He said authorities still don't know what sparked the incident.

Grapevine Police Lt. Todd Dearing said investigators believe that the victims were related, though some were visiting and didn't live in the apartment. He said police are looking for other relatives to inform of the deaths.

"Seven people in one setting in Grapevine, that's never happened before. Ever," Dearing said.

Police and firefighters first rushed to the Lincoln Vineyards complex after receiving the open-ended 911 call at about 11:30 a.m., Eberling said.

"There was an open line. No one was saying anything," he explained.

So police went into the apartment, located in the middle-class neighborhood of Grapevine, not far from the upscale Fort Worth suburb of Colleyville. The apartment was at the back of the complex, overlooking the athletic fields of Colleyville Heritage High School.

But many of the nearby apartments are vacant, and police said no neighbors reported hearing anything on a quiet Christmas morning when many people were not around.

Jose Fernandez, a 35-year-old heavy equipment mechanic who moved to the complex with his family about six months ago, said he always felt safe in the area, but is now afraid to let his 10-year-old son play freely outside.

"This is really outrageous especially on Christmas," said Fernandez, who was visiting family for the holiday and returned to find several police cars parked outside his home.

"This has shocked everybody. It has scared everybody. I guess something like this can happen anywhere, but seven people dead. It's just very scary," he added.

Eberling agreed the area is fairly quiet, noting this would be the first homicide in Grapevine since 2010.

Christy Posch, a flight attendant who moved to the complex about six months ago so her son could attend the high school, said she lives a few buildings away and did not hear any gunshots.

"It's all families. That's why I moved here. No burglaries, no nothing," Posch said.

Ontario university student dies in car rollover

Family members have confirmed Carleton University student Caylynn Kijowski, 20, of Grey Highlands, Ont., is dead after the car she was driving rolled into a ditch and struck several trees near her hometown.

Kijowski was travelling on Grey Road 18 in Meaford, close to Owen Sound, Ont., shortly after 4 a.m. Friday with a male passenger, Steven Rutherford, 20, when she lost control of the vehicle.

She was taken to Grey Bruce Highlands Services Hospital where she was pronounced dead.

Rutherford was taken to Owen Sound hospital for serious injuries and was later released.

Kijowski was studying criminology and criminal justice at Carleton and had come home several days before to celebrate the holidays.
