$21M awarded in torture suit against ex-Somali PM

McLEAN, Va. (AP) ? A U.S. judge on Tuesday awarded $21 million to seven people who sued a former prime minister of Somalia now living in Virginia, claiming he tortured and killed his own people more than two decades ago.

The judgment against Mohamed Ali Samantar, 76, of Fairfax comes at the end of an eight-year legal battle that went to the U.S. Supreme Court.

Seven Somali natives filed the lawsuit in 2004 in federal court in Alexandria against Samantar, who served as vice president, defense minister and prime minister throughout the 1980s under dictator Siad Barre, until the months before the regime collapsed in 1991.

The suit claimed Samantar personally ordered the killings and torture of members of the minority Isaaq clan.

Samantar denied the accusations and claimed immunity from the lawsuit. On the day the trial was to begin, he entered a default judgment. While he accepted legal liability for the killings, he denied wrongdoing.

One of the plaintiffs, Aziz Deria of Bellevue, Wash., said Tuesday that the ruling vindicates efforts to hold Samantar accountable.

"The case was never about money," said Deria, who has little expectation of recovering his $3 million share of the judgment against Samantar, who is bankrupt. "This case was about having an opportunity to be in court with Samantar and prove he was in charge of what was happening."

Samantar's lawyer, Joseph Peter Drennan, said he will appeal the ruling. In fact, the case is already on appeal. The 4th U.S. Circuit Court of Appeals is considering whether Samantar was properly denied immunity.

The case, first filed in 2004, has had a tortuous path through the courts. At first, U.S. District Judge Leonie Brinkema dismissed the case, ruling that Samantar enjoyed legal immunity as a former foreign official. But the U.S. Supreme Court rejected that argument. Eventually, the State Department argued in a legal filing that Samantar could not claim immunity because Somalia had no central government that could claim immunity on his behalf.

Brinkema then allowed the case to go to trial. Samantar's lawyer objected, saying the judge was granting excessive deference to the State Department ? Brinkema had said she would have dismissed the case if the agency determined it could harm international relations.

After Samantar defaulted at the outset of the trial in February, the trial proceeded without him.

During the shortened trial, the plaintiffs presented evidence including a 1989 BBC interview in which Samantar acknowledged a leadership role in the bombing of Hargeisa, a city in the northern part of the country. Hargeisa was home to a large Isaaq population and a stronghold of a regional movement to break off from Somalia.

The evidence also included testimony from an army colonel who said he overheard a series of radio communications in which Barre was urging moderation in a bombing campaign, while Samantar advocated a harsher attack.

Several plaintiffs ? some who live in the U.S. like Deria and others who still live in Somalia ? told chilling stories of narrowly escaping summary execution, suffering beatings and spending years in solitary confinement in jail. Deria sued on behalf of his brother and father, who were killed.

The San Francisco-based Center for Justice and Accountability, which represented the plaintiffs, said Brinkema's ruling is the first anywhere in the world to hold a leader in the Barre regime responsible for the crimes it perpetrated.

"This is a remarkable result for our clients, who faced down one of the most powerful men in their country's history and forced him to concede liability for his crimes," said Steven Schulman, one of the plaintiffs' lawyers.

But Drennan said Samantar continues to deny wrongdoing, and believes that efforts to hash out these claims in a U.S. court are counterproductive to the efforts to promote reconciliation and a cohesive national government in Somalia.

The lawsuit "needs to be seen for what it is ? politics and clan warfare in the courtroom," Drennan said.

Deria, on the other hand, said holding Samantar formally accountable for atrocities in Somalia's civil war is the best way for Somalia to move forward. He said that clan retribution can be set aside when people can be assured of justice through the legal system and that he hopes the case can highlight to the Somali people that justice is attainable.

"This is the civilized way of dealing with criminals," he said.

7 Ways to Jumpstart Your Workout ? Sunwarrior News | Vegan ...

Do you often feel like you don?t have the time or energy to get in a good workout? I promise, I know the feeling. Some mornings when my alarm goes off, all I want to do is unplug it and snooze for an extra hour instead of heading out for a run. It got especially hard when I started marathon training. As the runs got longer, my start time had to get earlier and earlier to keep my running schedule from interfering with my work day.

These little tricks helped me immensely during?marathon training, and they?re definitely the reason that I?ve been able to keep up a regular running routine now that there?s nothing that I?m training for.

1. Drink less booze.?This might seem like a no-brainer, but the night before your workout, skipping the booze in favor or water can make a big difference. Even low levels of dehydration can impact your workout, and you?ll have a much easier time exercising if you didn?t drink the night before. If just water seems a little boring, try?whipping up a healthy mocktail, so you won?t feel left out.

2. Try intervals.?If you?re getting tired of your routine or you feel like you?ve hit a plateau, working in some interval training can kick things into gear. Intervals are simple to do: you rotate between an easy and difficult pace. For example, on our Friday runs, my partner and I do two minutes of running as fast as we can, then two minutes of walking for our three mile route.

3. Take it outside.?If you?re used to working out at the gym, try taking your?workout outdoors. Walking, running, cycling, or even yoga outside is a whole different experience than inside a gym with all of the fluorescent lighting. One of the hardest runs I had during marathon training was on a treadmill, and it was less than half the distance of most of the runs in that training program.

Tip: The American Heart Association recommends 150 minutes of exercise per week. That?s 30 minutes per day, Monday through Friday, or 50 minutes three times a week.

4. Prioritize it.?A workout doesn?t have to take a long time, and it?s much easier to keep at it if you block out that time in your week. Put your workout on your calendar and think of it like any other appointment. Try not to skip your workout unless you have a really good reason, like illness or injury.

5. Get a?buddy.?You know those mornings when you?d rather take a hammer to the alarm clock than get up and go exercise? This is where a buddy is invaluable. It?s much harder to flake on your workout when you know that you?re ruining your buddy?s workout, too. It?s also nice to just have someone to chat with to pass the time while you?re exercising, and you guys can challenge each other.

6. Drink up.?No, not booze! Bringing plenty of water can help your stamina while you?re exercising. If you?re doing longer workouts, you might consider investing in a water belt, so you can bring plenty of water with you without having to hold a bottle in your hand.

7. Just?go.?Don?t feel like going on a five mile run this morning? That?s OK! Often just getting started can help you push through that block. Tell yourself that you?re only going to do one mile. Or three miles. If you just do that much, you?ll be glad you got out there, and if you might just be able to push yourself to do your full workout after all.

Real estate pair's focus now on fair compensation - Stuff.co.nz

After battling a strike, arson, aftershocks and insurance hassles, two property owners have accepted that the central Christchurch blueprint has ended their 18-month fight to rebuild.

Rob McCormack and Peter Greene have spent $1 million trying to replace the Madras St headquarters of McCormack's real estate business, Harcourts Grenadier.

McCormack said he was "absolutely gutted" to learn their site was in the blueprint's green frame just as they were finally making progress.

"But I'm philosophical now. I don't have a choice," he said.

"We happen to be in the way of the frame. We don't want to be an obstacle. Some people will have to take some pain, and that's us."

When the Grenadier building was wrecked in the February 2011 earthquake, the pair aimed to have its $8.9m, four-storey replacement up within a year.

It would have been the first office building rebuilt in the central city.

They immediately struck setbacks securing insurance and had to design the building for extra strength.

McCormack estimates he was spending 12 hours a week in meetings and negotiations, on top of his normal business.

Then their specially sourced 11-metre piles were blacklisted by Auckland port workers because they had been unloaded by non-union labour during a strike.

After the piles arrived three months late, the specialist piledriver was torched by arsonists and needed parts from Canada.

Then the blueprint came out and their property was within the frame.

"At first I couldn't absorb it," McCormack said.

"How much bad luck can anyone have - an earthquake, losing your building, not being able to get our piles, some bugger torching it, and then the Government goes and takes your land?"

Now the pair have a new fight on their hands - compensation.

They have met the Canterbury Earthquake Recovery Authority (Cera) to discuss a payout for their property and are optimistic they will get back the $1m spent on demolition, consents, piling, engineers, architects and project management, plus the $1.8m they estimate their land is worth. McCormack is unhappy they will not be offered back their land later.

"They (Cera) gave us a very, very good hearing. We're not trying to make money; we only want what is fair."

He will be "extremely disappointed" if the negotiations do not result in an acceptable price.

We are more easily influenced when we follow our heart

ScienceDaily (Aug. 28, 2012) ? When we let our hearts choose for us, we are more influenced by people who resemble ourselves, a PhD study from BI Norwegian Business School shows.

Every day we have to make a number of choices, and it is not always easy to know what the right choice is. That is why we often seek advice from others before making decisions. The Internet provides us with entirely new ways of finding out what other people feel about different products and services.

Many of us book hotel rooms online. Unless we are already familiar with the hotel, we will probably read reviews by former guests at the hotel before making up our minds. Such reviews are written by many different types of guests, families with small children, families with older children, single travellers, older guests and many other groups.

If you are a 25 year old student, for instance, you might attach different weight to a review from a student of your own age (the reviewer is similar to you) than you would to the comments from a 60 year old professor (who is different from you).

Influence from those who are similar

In his PhD study at BI Norwegian Business School, Ali Faraji Rad has conducted seven experiments to see whether we are more easily persuaded by people who are similar to us than by people who are dissimilar to us. He also looked at what circumstance might make the differences greater.

In all the experiments, participants were asked to imagine that they were going to book a hotel room online, and that they were reading a review of the hotel they were considering. Participants were then given a negative review of this hotel, along with a profile of the reviewer. The profiles were designed to create a feeling of similarity or dissimilarity with the participant in the experiment.

"Participants were more influenced by reviewers who were similar to themselves than by reviewers who were dissimilar. This difference was greatest when the choice of hotels was based on emotions and not logic," explains Ali Faraji Rad.

Logic and feelings

In the first experiment, half of the participants were asked to use logic in evaluating the hotel, while the others were was asked to base their evaluation on feelings. Those participants who based their evaluation on feelings, were influenced by reviewers similar to themselves.

Similar reviewers had no influence on participants who chose their hotel room on the basis of common sense and logic.

In the second experiment, half the participants were asked to write down some thoughts on why it is good to use logic when making decisions, while the other half was asked to write about why it is good to use our emotions when making decisions.

In this way, participants were primed to base their choice on logic or emotions.

The second experiment showed the same results as the first one. Participants who used their emotions were influenced, while those who followed their sense of logic were unaffected by reviewers who resembled themselves.

Business or pleasure

In experiments 3 and 4, Ali Faraji Rad instructed half of the participants to imagine that they were going away for fun, while the other half thought they would be travelling with work.

Previous studies have shown that we are more likely to use our emotions when we travel for fun than if we have more functional motives (such as a business trip).

Those participants who were thinking of a trip for fun were, as expected, more affected by the similar reviewer than those who were told to imagine a business trip.

Near and within reach

One half of the participants in the fifth experiment were asked to evaluate the hotel and imagine that they would be travelling next week, while the others were told they would be going in a year's time.

Participants who thought they were going next week were more influenced by similar reviewers than those who were to travel in a year's time. "Our choices are more based on emotions when they concern the near future."

In the sixth experiment, half the participants were told to imagine they were in a lottery where the chance of winning the hotel package was 1 to 5, while the other half received much longer odds, 1 to 5000.

Participants with the best chance of winning were more influenced by the similar reviewer than participants with longer odds.

"With a good chance of winning we feel that the trip is within reach, and we base our choice more on feelings," says Faraji-Rad.

Information in one's memory

In the seventh and final experiment of the PhD study, half the participants had to remember a seven-digit figure while assessing the hotel. The other half only had to remember a two-digit figure.

Earlier research has shown that we are more likely to use our emotions when we have to retain too much information in our memory.

Those participants who had to remember the seven-digit figure were more influenced by the similar reviewer (than by the dissimilar reviewer), even when they envisioned going on a business trip.

    If you live or work in a rural area of Victoria, it's likely that you have a chainsaw in your possession. Even though these machines can be highly useful in cutting up firewood and removing large amounts of wood and debris, they can also be highly dangerous and cause serious injury and even death if the proper safety precautions are not taken. Use the following tips to avoid some of the more common chainsaw accidents from occurring on your property:

    • Maintenance: Always ensure that the chainsaw is kept well maintained, clean and oiled. A rusty or un-oiled machine is prone to kickback, which can cause serious injuries.
    • Storage: Make sure that your chainsaw is kept well out of the reach of children and that the blade is covered to prevent anything from getting caught on it.
    • Starting: Whenever you are turning your chainsaw on, you need to make sure that it is on the ground and that you have one hand on the handle to hold it in place.
    • Protection: Always wear the proper safety gear when operating your chainsaw, such as goggles and earmuffs. This will protect your eyes from flying debris and your ears from the roaring engine.
    • Hands: Keep your hands away from the blade at all costs. You should also wear strong work gloves to protect your hands from the chain and to give you a better grip on the handle.
    • Use: Whenever you are operating a chainsaw, you need to ensure that your feet are planted firmly on the ground and that the blade is pointing away from your body.
    • Fuel: Make sure that you only use the mixture of petrol and oil that has been recommended by the manufacturer. If you are not sure what this mixture is, consult your owner's manual or contact the manufacturer.
    • Cutting: Don't try to cut with the nose of the chainsaw, as this causes the machine to kickback. This can cause serious injuries, as the blade is thrown back towards your face.

    No decisions at Friday's meeting with Samaras, says Merkel

    CHISINAU (Reuters) - There will be no decisions at Friday's meeting between German Chancellor Angela Merkel and Greek Prime Minister Antonis Samaras, Merkel said during a trip to Moldova on Wednesday.

    Merkel added she would wait first for a report by the troika of European Commission, European Central Bank and International Monetary Fund representatives on the progress Greece is making on the reforms international lenders have set as conditions for aid.

    Samaras started a European charm offensive on Wednesday with an appeal in Germany's Bild newspaper for more time for Greece to meet its borrowing obligations. He meets Merkel in Berlin on Friday.

    Garcia claims 2-stroke win at rainy Wyndham

    GREENSBORO, N.C. (AP) ? Donald Ross ? or, more specifically, his course at Sedgefield ? got the better of Sergio Garcia down the stretch once before.

    Not this time.

    Garcia held on to claim a two-stroke win Monday in the water-logged Wyndham Championship for his first PGA Tour victory in four years. He finished with a 66 to wind up at 18-under 262, claim $936,000 in prize money and, perhaps, vindicate himself for his meltdown here 2009.

    Back then, his three-shot lead midway through his final round slipped away, and he missed out on a playoff when his bunker shot stopped within an inch of the cup.

    Yet he insists he didn't come back to Sedgefield Country Club thinking the course owed him one.

    "That year, I was pretty much in control and I lost it myself," Garcia said. "The course didn't do anything wrong to me."

    Tim Clark was at 16 under following his 67 in the final tour event before the playoffs, and Bud Cauley finished 15 under after his 68.

    Garcia led both after the third round and when the fourth round was held up overnight due to a persistent downpour.

    He had three straight late-round birdies after a bogey briefly dropped him into a tie for the lead, and cruised to his eighth career PGA victory and first since the 2008 Players Championship.

    He began the decisive surge on the par-4 No. 13, plopping his chip roughly a foot from the flagstick and tapping it in for birdie.

    He added another birdie on No. 15 ? a pretty chip from a greenside bunker left him with a 5-foot putt ? and followed that with another birdie on the par-3 16th after his tee shot stopped within 2 feet of the stick. He added a birdie on No. 17 to move to 19 under, leaving his bogey on the final hole inconsequential.

    His strong finish can only help his Ryder Cup candidacy. The 10 automatic qualifiers will be set following the Johnny Walker Invitational with European captain Jose Maria Olazabal then making two picks.

    "We'll see when the team comes out, but I think my chances are a little better now," Garcia said.

    Nicolas Colsaerts ? whose 66 left him at 13 under ? wants a spot, too.

    "When you play rounds like these and you commit to tournaments and you get yourself in position like this and make the most of it, it just shows how much you want it," Colsaerts said.

    In addition to the quests by players on both sides for Ryder Cup selections, much of the focus ? as it always is at the tour's annual late-season stop in central North Carolina ? was on the chase to make the FedEx Cup playoffs, which begin in a few days at The Barclays.

    But everything wound up taking a back seat to the weather, as heavy rains dumped more than 2 inches of water on the course Sunday.

    The final round was halted at roughly 3 p.m. with 38 players still on the course and seven players within three shots of Garcia. The decision came 2? hours later to hold off until Monday morning ? the first Monday finish in Greensboro since 1983.

    Clark, a South African and local favorite who played at North Carolina State, matched Garcia at 15 under with a birdie on his third hole of the day, the par-4 No. 8. Garcia moved to 16 under with a birdie on the par-4 No. 11, but he gave that stroke back with a bogey on the next hole after missing a 10-foot putt for par.

    Moments later, Chad Campbell joined them atop the leaderboard after his third consecutive birdie came on the 17th. Then Garcia made his big move.

    "It was going to be tough to catch (Garcia), the way he finished," said Clark, who moved to 54th on the points list after not even being in the playoff picture a few weeks ago. This was his fourth top-15 finish since late June.

    Among the playoff hopefuls, Heath Slocum was the only one to start outside the top 125 and play his way into The Barclays. His final-round 71 left him at 7 under for the tournament and pushed him to No. 124.

    "Every little point helps, every little dollar helps," Slocum said.

    Jason Dufner could have taken over the top spot on the points list with a win, but he finished five strokes back and wound up leapfrogging Rory McIlroy for No. 2 behind Tiger Woods. He came in at No. 3, the highest-ranked player in the field.

    New Zealand signals earlier exit from Afghanistan

    (AP) ? New Zealand Prime Minister John Key announced Monday that the country will withdraw its troops from Afghanistan earlier in 2013 than planned. He said the move is not prompted by the deaths this month of five New Zealand soldiers, including three who were killed Sunday by a roadside bomb.

    August's deaths account for half of all fatalities suffered by the small contingent of New Zealanders in the nine years they have been stationed in central Bamiyan province, which was comparatively stable until a recent upswing in violence.

    Key said it was "highly likely" the remaining soldiers from the contingent of 145 would be withdrawn in April 2013. He said discussions for the earlier withdrawal began before the five deaths this month. Murray McCully, New Zealand's foreign affairs minister, had announced in May the troops would be withdrawn "in the latter part of 2013."

    Key said he wants to bring home the troops as fast as practicable within a timetable that fits in with the coalition partners.

    "We'll do it as fast as we can, and we'll do it in the way that protects our people as best we can," he said.

    The U.S.-led NATO forces in Afghanistan plan to end their decade-long combat mission and withdraw almost all troops by the end of 2014. The U.S. this year has been withdrawing a planned 23,000 troops, which would leave 68,000.

    Key rejected calls to end New Zealand's role in Afghanistan immediately.

    "Yes we need to make it the shortest timeframe we can now logistically, but we have to do it with our partners. If we don't, then the message we send to the rest of all of Afghanistan is that it's time to run for the exits," he said. "And if we do that, then the thousands of people who have lost their lives have been in vain. And I just don't think that reflects the values and principles that underpin New Zealand."

    The move is likely to be popular among many New Zealanders, who have increasingly questioned the country's role in the conflict. The New Zealand troops were sent there ostensibly as a reconstruction team, with the mission of helping to rebuild and protect Bamiyan province's infrastructure and social systems. In recent months, however, that role has increasingly given way to combat operations, as violence in the region has increased.

    The latest incident on Sunday also marked the first time a New Zealand woman has died in the conflict. Lance Cpl. Jacinda Baker, a 26-year-old medic, was killed in the explosion, as were Cpl. Luke Tamatea, 31, and Pvt. Richard Harris, 21.

    According to defense force officials, the three were traveling in a convoy of four Humvees on Sunday to escort a soldier suffering a medical condition back from a visit to the doctor when a roadside bomb exploded, destroying the vehicle and instantly killing the occupants.

    Lt. Gen. Rhys Jones, chief of the defense force, said the Taliban have taken responsibility for the attack.

    Earlier this month, two New Zealand soldiers were killed and another six injured during a gunbattle with insurgents in the same region.

    Syrian president makes rare public appearance

    BEIRUT ? Syrian President Bashar Assad attended prayers in a Damascus mosque to mark the start of a Muslim holiday on Sunday, his first appearance in public since the bombing last month that killed four of his top security officials.

    Elsewhere in the country, thousands staged anti-government protests in mosques and cemeteries following special prayers marking Eid al-Fitr, the three-day holiday that ends the holy fasting month of Ramadan. Pious Muslims traditionally visit graves and recite prayers for the dead on the holiday.

    Amateur video posted by activists on the Internet show a large group of worshippers in a mosque at al-Zahera district in Damascus shouting: "There is no God but Allah" and "Assad is the enemy of God," while clapping their hands over their heads.

    Ramadan in Syria was particularly deadly this year as the civil war reached the two largest cities, Damascus and Aleppo. The Syrian regime has suffered a series of setbacks over the past month that point to a loosening of its grip on the country.

    The July 18 rebel bombing of the state-security headquarters in the capital was a major blow to Assad. His brother-in-law was among the four killed officials.

    There has also been a steady stream of high-level defections by government officials, diplomats and generals, though Assad's inner circle and military have largely kept their cohesive stance behind him. And the regime has been unable to fully subdue rebel challenges in the two major cities, Damascus and Aleppo.

    Syrian state TV broadcast footage showing Assad praying at the city's Rihab al-Hamad mosque, a relatively small mosque in al-Muhajireen district only few hundred meters (yards) from the presidential palace.

    Residents of Damascus said security forces blocked streets and encircled several central mosques in the capital from Saturday evening, possibly to confuse people about where Assad would attend the traditional holiday prayers.

    Unlike previous years, Assad was not shown arriving or leaving in his convoy. He was pictured seated cross-legged on the mosque floor, wearing a suit and tie, and later, standing and briefly shaking hands with officials before leaving.

    "All this points to a state of confusion and lack of confidence at the leadership level," said Syria-based activist Mohammad Saeed. "It shows they don't have security in the capital under control."

    Assad's appearance comes amid much speculation on the whereabouts of Vice President Farouk al-Sharaa, who was said by some members of the Free Syrian Army to have defected to the opposition. On Saturday, his office denied the reports. Al-Sharaa was not shown in the footage at the mosque with Assad, but observers said the two rarely attend the same functions for security reasons.

    The last time Assad appeared in public was on July 4 when he gave a speech in parliament.

    Since then, there has been a sharp escalation in the civil war with almost daily fighting in some districts of the capital.

    As it battles for survival against the rebels, the regime has increasingly resorted to the use of airstrikes, particularly in the north where rebels have seized large swathes of territory.

    Abdelbaset Sieda, president of the Syrian National Council opposition group, reiterated his call for international powers to militarily enforce a no-fly zone that would prevent Syrian regime aircraft being used against rebels as well as safe corridors to protect civilians.

    "Failing that, the entire region is headed toward a future open to all kinds of catastrophic possibilities," the Sweden-based Sieda said in a speech addressing the Syrian people for Eid al-Fitr. A video of the speech was posted on YouTube.

    The Syrian opposition has been calling for a no-fly zone over parts of Syria for months. Russia, one of Syria's most powerful international backers, rejects the idea.

    Syrians also protested in many other parts of the country, demanding freedom and the ouster of the regime.

    Opposition groups reported fierce artillery shelling that targeted a main cemetery in the rebel-held town of Rastan, north of the central city of Homs. Activists said residents were visiting graves of dead relatives at the time, but the reports could not be independently confirmed.

    The British-based activist group Syrian Observatory for Human Rights said one woman was killed in the shelling of Rastan.

    NBA Free Agency: Former Pistons Center Vernon Macklin To Sign With Turkish Team, Per Report

    Former Detroit Pistons forward/center Vernon Macklin has signed with the Gaziantep club in Turkey, according to Hoopshype. Macklin's agent Greg Nunn spoke to Hoopshype about the decision:

    "Vernon decided to turn down three NBA camp invites," Nunn said. "He feels he needs to play to showcase his talents and return to the NBA next year."

    Macklin averaged 2.0 points and 1.5 rebounds per game in 23 games as a rookie after Detroit picked him in the second round in 2011. He also had an impressive showing in the D-League. The Pistons reportedly liked Macklin. He played with the team in the Orlando Summer League despite not being under contract, but their roster situation made it difficult to keep him. The team currently has a full roster, including five rookies ? Andre Drummond, Khris Middleton, Kim English, Kyle Singler and Slava Kravtsov. Plus, if Ben Wallace decides to play one more season, the Pistons will need to find a roster spot for him, as well.
